1. CONTRACT OF CARRIAGE
1.1 The contract of carriage
a) The purchase transactions made, from Italy, on the www.corsicaferries.com - www.sardiniaferries.com sites, are stipulated with Forship Spa - Single-member company: Registered office: Piazza della Vittoria 8/20 - 16121 GenoaAdministrative office: Calata Nord/Porto Vado - 17047 Vado LigureCourt: n. 22367C.CIAA GE 430475Cap. Company of € 1.424.160 ivPI 01977660925C.F. 80035370107
b) Except as specified below, the contractual carrier is therefore to be understood as Forship spa Società Unipersonale - which assumes carriage under the terms and conditions set out in the "General conditions of carriage" and in the articles of the Italian Navigation Code and the Italian Civil Code and in general by Italian law.
c) Only for transports departing from or arriving in a French or non-Italian port, Forship does not act as a contractual carrier but as an agent who sells passage tickets on behalf of Corsica Ferries SASL Le Palais de la Mer Avenue Pascal Lota BP 27520296 Bastia Cedex - which is therefore to be understood as the only contractual carrier of these routes, always under the terms and conditions set out in the "General conditions of transport" and in the articles of the Italian Navigation Code and the Italian Civil Code and in general by Italian law.d ) The collection by the passenger of a ticket issued by Forship in the aforementioned qualities implies acceptance by the passenger and/or owner of the vehicle, whose name is indicated on the ticket, of the conditions governed by Italian law and by these "General Conditions of Carriage" as an integral part of the ticket itself. e) In particular, the purchase of the ticket involves a, by the passenger, acceptance of the following clauses: Tariff Application, Travel document-Ticket, Boarding rules, Responsibilities and particular obligations of the passenger, Responsibilities and rights of the carrier. f) The Santa Teresa – Bonifacio route and vice versa is operated by Ichnusa Lines whose transport conditions, published on the website
www.ichnusalines.com and to which reference is made, will apply. The carrier for these routes is therefore GENOVA TRASPORTI MARITTIMI SRL (GTM). Forship does not assume any role of carrier nor any carrier responsibility, operating exclusively as an agent that sells passage tickets on behalf of Srl GTM.
1.2 Definitions: The term Passenger means any person transported on the basis of a ticket. The term carrier means the company that carries out the maritime transport. All employees, officers and assistants of the Carrier will be able to benefit from the rights guaranteed to the Carrier by these general conditions.
1.3 Jurisdiction: All disputes that may arise between the Passenger and the Carrier in relation to this contract will be devolved to the competent Ordinary Italian Judicial Authority and more specifically to the Court of Genoa.
1.4 Load unit: For all legal purposes, the transported vehicle - including any trailer or caravan, with everything contained therein - constitutes a single load unit embarked without declaration of value.
1.5 Fares: These are those in effect at the time of ticket purchase and indicated on it.
1.6 Damage to persons and vehicles: Any liability of the carrier for damage to persons and vehicles being transported is insured as provided for by the current provisions of the flag law and by the applicable International Conventions.
No claim for damages will be processed in the absence of the damage report drawn up by the crew at the time of the accident.
1.7 Carriage contract: The passenger is required to comply with the provisions of the laws of the countries in which the Carrier operates, as well as with the regulations of the Carrier (both the contracting carrier and the carrier operating the transport) and with the provisions of the Captain of the Ship.
2. BOOKING - FERRY RATE
2.1 Booking
The fare and availability information is provided in real time by the ticket issuing company on the websites indicated in point 1. The prices that appear during the request for a quote are guaranteed for the entire duration of the user's connection. The reservation becomes definitive only after the "Confirm" button has been clicked and when confirmation of the credit card transaction used for this purpose has been received. The reservation can be canceled, without penalty, by midnight on the day on which it is been carried out; after this term, the cancellation will be subject to the penalties provided for in these conditions or in the conditions indicated online at the time of booking. Changes to date, time, line and services made on the day of booking will not be subject to penalties, however the any tariff differences. The ticket will be sent to you by email, free of charge, to the email address you indicated.
2.2 Type of payment - Credit card :
The accepted credit cards are the following: - VISA - MASTERCARD - AMERICAN EXPRESS Transactions are carried out in total security, thanks to the SSL (Secure Socket Layer) encrypted system. All transactions are carried out in Euros , including Switzerland. To ensure greater security, entering the Security Code is mandatory (see "passenger info" online help). Payment transactions are made when the ticket is purchased, after clicking on the button "Confirmation".
2.3 Handicapped passengers: Handicapped passengers are requested, before booking, to consult
clause 5.6 of the General Conditions of Carriage .
Passengers with hidden disabilities will receive an adequate welcome from the boarding staff and crew, who will make their journey accessible and simple. For this to happen, they must select the word Assistance and communicate their specific needs to the Airport Manager upon arrival at the port. Passengers with hidden disabilities who arrive at the port without having selected the word Assistance are advised to report their needs and the attention they require to the ship's Reception immediately after boarding, during the journey and upon disembarkation.
3. TARIFF APPLICATION
3.1 Application of ferry rates : Prices vary according to the time of booking and the rate applied to the chosen journey.
The price of the passenger may vary depending on whether it is booked with or without a motor vehicle (car, motorbike, camper, etc.).
The price of the cabin is flat rate for the number of passengers included in the ticket. The discount for children concerns the price of the crossing and not that of the cabins and the supplement. Discounts and/or special rates cannot be combined. For bookings made via the internet , as reimbursement of transaction costs, the sum of €8 will be charged, non-refundable even in the event of cancellation of the contract. The Company reserves the right to apply any additional tariffs after the purchase of the ticket, depending on fuel of tax encumbrances in application of safety regulations and the ISPS code. If the passenger does not intend to pay the aforementioned supplements, he can cancel the booking and obtain a refund of the ticket.
Promotional rate tickets: Tickets containing a promotional rate service cannot be changed or refunded in the event of partial or total cancellation. Standard Fare
Tickets : Standard Fare tickets can be modified but a sum of € 30.00 per journey must be paid and any fare differences will be collected.
These tickets are non-refundable, neither partially nor in full.
FLEX fare tickets: FLEX fare tickets can be changed and any fare differences will be collected for each change.
The "FLEX Fare" option can only be purchased at the time of booking. In the event of total or partial cancellation, FLEX fare tickets will be subject to the penalties indicated below, on the total ticket - excluding taxes: 10% up to a month before departure 20% up to 48 hours before departure 50% up to the time limit for showing up for boarding 100% after the time limit set for boarding Tickets canceled after the time limit set for boarding (1 hour before departure) or after check-in will not be refunded and will lose their validity. For cancellations of tickets in which a date change has been made, the initial departure day will be taken into account. Failure to show up for boarding will also invalidate the ticket, which cannot, in any way, be refunded. total cancellation of the ticket paid by credit card, and with refund of taxes (port, regional and security taxes) the amount of € 3.50 will be charged for management costs, each way, as well as the amount of € 1 for management fees, per passenger. If the total or partial cancellation occurs less than 48 hours before departure, no refund will be made (except Flex fare tickets).
Freight tickets : In case of total or partial cancellation, the following penalties will be applied to the total freight ticket, excluding taxes:
20% up to 48 hours before departure, 50% up to 24 hours before departure, 100% tickets canceled on day of departure.On the Livorno, Piombino/Golfo Aranci lines:- without penalty up to 48 hours before departure, 20% up to 24 hours before departure, 100% less than 24 hours before departureIn case of change of date, the Merci tickets can be changed: - without penalty up to 24 hours before the initially scheduled departure date 30% penalty if the date change is made on the same day of departure. Refund requests must be sent exclusively by
e-mail indicating the relative number of ticket.
Tickets paid for by credit card online or by telephone through our booking office are refunded by crediting the credit card used for the purchase. Tickets paid by bank transfer, cheque, cash or by credit card at our offices at the ports of embarkation or using manual POS are refunded by bank transfer (please communicate the IBAN of your current account when requesting a refund The refund request must be made by the customer within two months of the travel date. For tickets purchased through a travel agency, the request must be sent to the agency that will refund the ticket.
Changes : FLEX Rate and Standard Rate
No refund will be recognized in the event of a change in date, time, route, type of accommodation or vehicle category.
On the Standard fare, a sum of € 30 will be received for any change to the travel document and any fare differences will be collected. On the FLEX fare, any fare differences will be collected for any change to the travel document. No refund will be recognized if the fare of the new journey is lower than that of the originally booked journey. Changing the name of one or more passengers is not permitted. Correction of data is authorized only once and is subject to payment of €8. accommodation on board no reimbursement will be recognized for changes requested by the passenger (for example passage from a booked cabin to a seat) a right to reimbursement of expenses will be charged for any change to the ticket.
Vehicle booking : At the time of booking it will be essential to specify the dimensions and characteristics of the vehicle. For the calculation of the fare, the overall measurements (length, height and width) are taken into consideration, which must be declared at the time of booking and when purchasing the ticket.
Vehicles exceeding normal dimensions: Vehicles exceeding 5.00m in length and/or 1.90m in height and/or 2m in width, subject to the payment of a surcharge, must be declared at the time of booking. In the event of omission or false declaration, the Company reserves the right to refuse boarding or to collect the amount due, even on the outward journey even if already made. The embarked vehicle will be considered for all purposes of the law as luggage passenger.
Time to think : the Time to Think option guarantees a refund of the ticket within 48 hours of confirming the booking, whatever the fare category.
After cancellation, the total amount of the ticket will be refunded (except for the sum of €5, option cost) according to the payment method chosen. After 48 hours, the reservation is automatically and definitively confirmed and, in case of cancellation or modification, the fare conditions of the ticket will apply.
Food Pass formulas, vouchers, gift certificates: non-refundable offers, it is not possible to give change. The voucher is not redeemable for cash.
4. TRAVEL DOCUMENT-TICKET
4.1 Validity : The passage ticket is valid only for the persons to whom it is registered, for the ship for which it was issued and for the accommodation and departure indicated therein. The ticket cannot be transferred. Unless otherwise expressly indicated, the ticket price is per person and seat, excluding food, and is inclusive of VAT, if due.
4.2 Safekeeping : The Passenger is not required to keep the paper copy of the ticket. The boarding system is computerized, this allows you to simplify and limit the documents needed to travel. It is essential that the reservation number appears, assigned by our central reservations, which can also be communicated verbally at the time of boarding or in the event of checks carried out by the Company's staff, during the journey and/or in the ports of departure and of I arrive.
5. BOARDING RULES
5.1 Presentation : The Passenger, with or without a vehicle, must report directly to the ship within the deadline indicated in the valid publications (tickets, timetables, fares and other notices): : with vehicle 1 hour before departure, without vehicle 1/ 2 hours before departure. After this term, the Passenger loses any right to embark. Departures can be anticipated by 1/2 hour compared to the published timetable.
5.2 In compliance with the international ISPS code, relating to anti-terrorism regulations, passengers will be obliged to show a paper copy of the ticket (if received) and a valid identity document and will have to consent to the inspection of their vehicle and baggage, if requested by a ship's officer or Company personnel, before boarding and during the crossing. Any refusal will result in the failure to authorize boarding. Passengers are therefore requested to always carry with them: a valid identity document, proof of any reduction and a paper copy of the ticket (if received) or they can communicate the reservation number.
5.3 Vehicles : Whatever the order in which they are presented, the Carrier and/or the Captain and/or the Loaders have the right to establish the order of embarkation of the vehicles at their sole discretion. If due to force majeure the Carrier is unable to embark a vehicle that has been duly booked, this vehicle will take precedence in the next departure without the passenger being able to claim compensation of any kind. If, upon arrival at the port of destination, the sea conditions or other causes independent of the Carrier's will do not allow the vehicles to be disembarked, these will be disembarked as soon as possible at the next landing or in the port of origin without the Passenger being able to claim any compensation. For each vehicle with dimensions that do not correspond to those declared at the time of booking, the Carrier reserves the right to refuse boarding and/or to collect the freight for oversized vehicles. The embarkation and disembarkation operations must be carried out personally by the Passenger driver. The vehicles must be driven to the entrance to the ship's door in the case of embarkation, and from the entrance to the ship's door onwards in the case of disembarkation, under the direct and exclusive responsibility of the Passenger driver who must comply with all safety regulations in force for circulation on the port quays concerned. Inside the ship, the Passenger-driver must position the vehicles according to the instructions given by the personnel on board. Vehicles embarked must be left closed and secured by the Passenger driver with first gear engaged and the parking brake on. The transport of perishable foodstuffs is not recommended due to the high temperature in the garage.
5.4 Baggage . Every foot passenger is entitled to free carry-on baggage. The baggage must contain personal belongings of the passenger which are transported in suitcases, boxes or the like, which do not have bulky structures and whose dimensions do not exceed 200 cm. in height, 100 cm. wide and 50 cm. of depth. The passenger can bring his own baggage with him in the cabin or in the assigned seat, under his total responsibility. Canoes, kayaks and other oversized baggage, if not transported on the roof of the vehicle, must be deposited in the ship's garage subject to acceptance by the loading officer. Such baggage will be subject to the payment of fees established by the Company. The Company declines all responsibility in the event of theft or damage to baggage. Valuables and money will be considered delivered to the carrier only if deposited against the payment of a fee with the purser.
The carrier assumes no responsibility either for the luggage kept by the passenger, or for the luggage placed in the areas set up for this purpose, unless proof of fault of the Company is provided. However, even in the event of ascertained liability of the Company, the lump-sum compensation cannot exceed the limits established by Reg. 392/2009.
5.5 Medical conditions of the passenger - Pregnant women :
Medical conditions of the passenger : Special medical conditions must be declared at the time of booking. The carrier may refuse boarding to passengers who need medical assistance during the journey since the on-board doctor, if present, provides assistance only in emergencies. If the passenger presents himself with a suitable medical certificate, issued by a public health facility (hospital, local health authority) certifying that the passenger himself does not require medical assistance during transport, the carrier will embark him, declining any responsibility in this regard. The Captain also has the full right to refuse boarding to anyone who is in physical or mental conditions that do not allow them to undertake the journey or to anyone who is dangerous for other Passengers due to the abuse of drugs, hallucinogens or alcohol. In all the cases mentioned above, the passenger will not be entitled to compensation for damages and will be liable for damages caused to himself, to the ship, to all its fittings and/or equipment, to third parties, as well as to third party property. The acceptance of the passenger on board by the carrier must not be considered as a waiver of any right to subsequently assert its reservations on the passenger's conditions, known or not by the carrier at the time of embarkation and/or departure of the ship. Pregnant women: Pregnant women who have concluded the 6th month of gestation must, compulsorily, have a medical certificate authorizing the journey, to be shown at the request of the crew. In the event of a pregnancy with complications, the pregnant passenger must necessarily have a medical certificate authorizing the journey, regardless of the month of gestation. The Captain also has the full right to refuse boarding. The carrier's consent to boarding should not be considered as a waiver of subsequently asserting its reservations on the passenger's condition, known or not by the carrier at the time of boarding and/or departure of the ship. The passenger will not be entitled to compensation for damages and will be liable for damages caused to her person, to the ship, to all its fittings and/or equipment, to third parties, as well as to third party property.
5.6 Disabled people or people with reduced mobility (PRM) : When booking, passengers must indicate that they are people with reduced mobility, in order to receive adequate assistance to make their crossing smooth and comfortable.
For easier access to the ship, PRM passengers must present themselves to the port manager before the start of boarding operations, at least 1 hour before the departure time. In the garage, the parking areas located near the lifts and which are reserved for cars of passengers in wheelchairs, will be assigned exclusively to these people, in the order of arrival. Assistance may be more complex in busy periods.
5.7 Animals : Pets are accepted on board ships and can circulate in all public places, even in the self-service and restaurant in restricted areas, always in the company of their master and on condition that the following rules are respected:
- The leash and muzzle are mandatory for dogs, as well as the special cages for cats and other small animals. - Each animal must have a Certificate of Vaccination and Good Health valid for no more than 3 months from the date of issue .- For Corsica and the Balearic Islands it is necessary that the animals are over 15 weeks old, identification (microchip or tattoo) and an EU passport.- For the Balearic Islands, the anti-rabies vaccination is required.- The Company may refuse boarding of animals which due to particular characteristics (bad smell, state of health, hygiene or aggressive behaviour) prove to be annoying or dangerous for other Passengers.- It is strictly forbidden leaving pets in the vehicle (risk of death); during the crossing, the garage is not accessible and the temperature, especially in summer, can be very high. - Pets can accompany their owners in all public spaces and in dedicated cabins, however, the crew may impose restrictions their circulation.- Food and beverage containers must be fitted with a lid, to prevent any spills. Guide dogs accompanying blind or visually impaired Passengers may travel in the cabin with their master, provided they are on a leash and that the owner is liable for any damage they could cause to other Passengers. Blind or visually impaired Passengers traveling with a guide dog will not have to pay the fare for the transport of the animal and must communicate its presence at the time of booking. The Company declines any responsibility for damages, of any kind, which could occur during the crossing (illness, injury or death of the animal). Passengers must ensure that the regulations of the country of destination allow the transport of pets and their entry into the country, that the animals comply with the required hygienic-sanitary conditions and that they are in possession of all necessary documents, relating to their transport and their ownership. Dogs whose breed is considered dangerous according to the legislation in force are not accepted. The Passenger is responsible for any damage (for example, fines imposed by the country of destination, etc.) that the Company could suffer due to the carriage of pets not provided with the necessary documentation. The Company has the right to refuse the carriage of a pet that could cause danger or disturbance to the Passengers or the crew.
6. SPECIAL RESPONSIBILITIES AND OBLIGATIONS OF THE PASSENGER
6.1 Responsibility of the Passenger : The Passenger is liable for all damage caused (by him or by a person or animal in his care) to the ship, its furnishings, its structures and accessories, its equipment, other passengers, staff employee of the Carrier or its collaborators, to third parties, as well as all sanctions, contraventions, fines and/or expenses to which, due to them, the Carrier is subjected by any authority of any country.
The Passenger is required to comply with the rules of conduct dictated by prudence, also in relation to the typical risks of navigation. In particular, the Passenger acknowledges that the technical fact of navigation is by nature subject to meteorological and marine conditions and involves inevitable rolling and/or pitching movements as well as general conditions of humidity of the surfaces, both external and internal. The Passenger therefore undertakes to follow all the instructions of the Captain, the crew and the signs present on board, to use all the handles and handrails of support and support and in general to adopt a prudent conduct declining the company any responsibility for damage to persons and/or things caused by imprudent conduct.
6.2 Unaccompanied Minors : Minors under the age of 16 cannot travel unaccompanied. They must be under the custody and control of their parents and/or under the responsibility of an adult escort/guardian and cannot walk around the vessel if unaccompanied.
Important advice: on international lines, minors traveling under the responsibility of adults who are not their parents or legal guardians must be in possession, in the event of checks by the competent authorities, of their own identity document, a written authorization from the parent/legal guardian and a copy of the identity document of the latter. Children between the ages of 16 and 18 can travel unaccompanied, with indemnity filled in by their parents and a copy of the documents of the parents or legal guardian. All passengers, including those under the age of 18, must always be in possession of a valid identity document.
6.3 Self-certification of minors : Documents are required to access the port, even for children. The self-certification declaration is no longer recognized by the competent authorities.
6.4 Weapons : Passengers are prohibited from bringing on board weapons and firearms, ammunition, explosives, fuel or other dangerous or flammable substances. At security checkpoints, these items will be seized, with no possibility of return or compensation. For more information

6.5 Vehicles powered by liquid gas, campers and caravans : At the time of embarkation, the Passenger must declare whether the vehicle is powered by liquid gas. Campers, caravans and motorhomes can carry up to 3 butane/propane gas cylinders for lighting, heating or cooking on the vehicle. The total weight of these cylinders shall not exceed 47 kg.
6.6 Illicitly held baggage : Passengers who should include in their baggage or in any case introduce on board illegally held or contraband substances and objects will be liable to the Carrier and/or other obliged parties for damages, fines and fines that they may possibly bear in consequence of this introduction.
7. CARRIER'S LIABILITY AND RIGHTS
The liability and rights of the carrier are governed by Regulation (EC) No. 392/2009 of the European Parliament and of the Council.
In particular, the Passenger accepts that the liability of the carrier is subject to an excess equal to 330 units of account in case of damage to a vehicle and 149 units of account per passenger in case of loss of or damage to other baggage; fast ferries Corsica Express III for technical reasons relating to passenger comfort and navigation safety, it will not be possible to make crossings in the presence of waves higher than 3 meters.
Where the Captain, at his sole discretion, finds such weather and sea conditions, the departure of the ship will be canceled due to force majeure and the passenger will retain the right to make the crossing on a subsequent departure of another traditional ship of the carrier. In such cases the passenger will only have the right to be reimbursed for any difference in fares with the exclusion of further compensation for damages. In case of crossing cancellation or delay of more than 90 m for whatever reason, passengers can choose between a refund of the ticket initially purchased, as compensation, or they can accept an alternative journey. The acceptance of an alternative crossing involves the waiver of the reimbursement of the initial crossing. Compensations which, calculated on the basis of the provisions of art. 19 Reg. 1177/2010, should amount to an amount lower than €. 6.00 as required by art. 19 no. 6 Cit. Reg.
8. PASSENGER RIGHTS
8.1 The rights of passengers traveling by sea and inland waterways are governed by Regulation (EU) no. 1177/2010 and
the text can be found by clicking here .
8.2 Reporting of accidents occurring on board the vessel : Any accidents of any nature must be immediately notified to the Purser on board. Reports of damage to vehicles must be immediately notified to the Loading Officers who will prepare the damage report on behalf of the Passenger. The Passenger must sign this report, which will not constitute acceptance of responsibility and/or acknowledgment of any kind by the Carrier. Reports not accompanied by a copy of the damage report will not be taken into consideration by the Carrier. Without prejudice to any limitation period more favorable to the Carrier, any action against the Carrier, whether contractual or non-contractual, for death or personal injury, loss or damage to luggage or vehicle or for compensation for damages in any capacity, will be considered as lapsed if the writ of summons is not served before the competent judge, within one year from the disembarkation of the Passenger. In no event shall the Carrier be liable for acts or facts which did not occur on board the ship.
8.3 Complaints : A complaint or a refund request can be sent by
e-mail or to: Forship Spa, Corsica Sardinia Ferries, Customer Care, Calata Nord - Porto Vado, 17047 Vado Ligure (SV), within two months from the date of journey, providing your name, contact details and ticket number. The complaint can be written in the following languages: Italian and English. To this end, you can use

Without prejudice to the possibility for the user to submit a complaint without using the facsimile form, provided that the complaint contains the following minimum information: - the user's identification references (name, surname, address) and any representative (in this case, attaching the proxy and an identity document of the user); - the identification references of the journey made (date, time of departure, origin and destination, booking code or ticket number); - the description the inconsistency of the service detected with respect to one or more requirements defined by European or national legislation, by the general conditions of transport or, where adoption is envisaged, by the service charter. We undertake to provide an answer to the complaint, in accordance with the provisions of article 24, paragraph 2, of Regulation no. 1177/2010, within 1 month of receipt of the same. By order of the Transport Regulation Authority, only after having presented a complaint to Forship Spa and after sixty days of sending it (for journeys departing from Italian ports or arriving in Italy), it is possible to contact the Authority itself, pursuant to Regulation (EU) n.1177/2010, relating to the rights of passengers traveling by sea and inland waterways, by e-mail to one of the following postal addresses electronic:

The user has the right to receive automatic compensation commensurate with the price of the ticket referable to the transport service in an amount of no less than:
10% in the case of a response provided between the sixty-first and ninetieth day from receipt of the complaint;
20% in the event of a response not provided within the ninetieth day of receipt of the complaint. Compensation is not due in cases where: - the amount of the same is less than 6 euros; - the complaint is not sent by the user with the methods, minimum elements and timing indicated above; - compensation has already been paid to the user in relation to a claim concerning the same trip.
