GENERAL CONDITIONS OF TRANSPORT AS OF 01/02/2013
The following general conditions of carriage are adequately advertised at all ticket offices, social offices and travel agencies. With the term & ldquo;passenger &rdquo ; means any person transported on the basis of these General Conditions for the transport of passengers and vehicles. The passenger & egrave ; required to comply with the provisions of Italian and foreign laws as well as ; the carrier's regulations (both the contracting carrier and the carrier operating the transport) and the provisions of the ship's master. When the carrier (contracting and/or effective ) is & ldquo;Moby SpA& rdquo ; for any reports or complaints, & egrave ; necessary to fill in the form on the website www.moby.it.
1) TRANSPORT REGULATIONS
The object of the contract is the provision of transport of people and luggage as governed by these general conditions, by articles 396 and following. code nav. and, starting from 31.12.2012, for international travel by regulation CE/392/2009. A summary of the provisions of the said regulation on passenger rights is provided . available on the website www.moby.it and at the check-in desks. The transport of the car in tow & egrave ; governed by the Italian rules on the transport of goods by sea (articles 419 and following of the Navigation Code) and by these general conditions. Information relating to passenger rights under EU regulation 1177/2010 is available on board ships and at check-in desks. Pursuant to art . 19.6 EU regulation/1177/2010 the minimum threshold below which the economic compensation is not payable ; expected & egrave ; equal to 6 (six) euros. The indication of the ship that will carry out the transport & egrave ; purely indicative as it is possible for the carrier to carry out the same with another ship, even from other carriers. The carrier declines all responsibility ; for damages caused to the passenger by the delay or non-execution of the transport if the event derives from unforeseeable circumstances, force majeure, adverse weather and sea conditions, strikes and technical failures constituting force majeure or other causes not attributable to it. & Egrave ; however faculty ; of the Captain of the ship, in the presence of events that may compromise the safety of the ship and/or passengers, change the itinerary . The offers and conditions advertised may be subject to change up until the time of ticket issue . For the liability regime ; in relation to the transport of passengers, cars and for anything not covered by these general conditions, express reference is made to the current provisions of the Italian Navigation Code. Until disembarkation, passengers are responsible for their luggage and its contents. The crossing times are indicative and calculated on the basis of the distance between the ports and in favorable weather and sea conditions. The carrier will not be able to be held responsible for delays due to port operations.
2) VALIDITY ; OF THE TICKET
The passage ticket & egrave ; personal, it is not ; transferable and & egrave ; valid only for the carriage specified therein. The passenger & egrave ; required to keep the contract/ticket to justify their right to travel and to show it to any officer of the ship, or carrier's official who requests it. The passenger who is found without a ticket will be penalised . required to pay double the price of passage, without prejudice to compensation for the related damages. Upon delivery of the ticket, the customer & egrave ; required to verify that all the data correspond to his request and that the vehicle data correspond to what is indicated in the vehicle registration certificate. The carrier assumes no responsibility ; for errors or omissions reported later.
3) TOTAL CANCELLATION OF THE TICKET AND REFUNDS
Tickets issued at the ordinary rate can be refunded as long as they are not paid . the cancellation takes place before the booked departure date, is documented with a validation stamp, date and time by an office of the carrier or an authorized travel agency and transmitted to our Reservation Center (limited to the call center hours ). The canceled ticket, in original must be ; must be handed over to the agency that issued it . The refund must be be requested from the issuing agency and it is ; always subject to the following penalties (the number of days indicated does not include the day of cancellation ): ALL TICKETS EXCEPT THOSE FROM AND TO ELBA : • 10% up to 30 days before departure; • 20% from 29 days up to 48 hours before departure; • 50% from 48 hours up to 4 hours before departure. No refunds if cancelled it will happen less than 4 hours before departure. For tickets purchased on the same day as the departure date, the cancellation fee is 50% . by 100%. By purchasing the insurance policy (see information material on the website www.moby.it) at the same time as the carrier's ticket, if an unforeseen event indicated by the relative conditions should occur, it will be possible to cancel the insurance policy . cancel the trip without losing the cost of penalties. Fees and charges are never refundable. ELBA: • 10% plus ; 30 days before departure; • 20% plus ; 10 days before departure; after this term: no refund, but the possibility of a refund . of reuse of the ticket as long as it is modified, within the same year as the date of issue, subject to booking confirmation. Fees and charges are never refundable. will NOT come . no refund is recognized if: • the passenger does not show up for departure; • tickets are not canceled before departure. For all destinations, the right to a refund lapses if it is not requested by 31 January following the year of the originally planned departure.
4) LOST OR STOLEN TICKETS ;
The loss or theft of a travel document must be immediately reported to the issuing agency or to the port office of the contracting carrier upon departure. The issue of the duplicate may be take place only on condition that the original ticket is not already registered ; used, upon presentation of an identity document ; and upon payment of the fee of € 10.00, against the administrative and management costs incurred by the carrier for this purpose.
5) FAILURE TO RECEIVE TICKETS PURCHASED ONLINE ;
Without prejudice to the provisions of article 4 above, in the event of non-receipt of a travel document for reasons not attributable to the carrier, including, by way of example but not limited to, the incorrect indication of the contact details provided by the passenger, the malfunction of its internet or mobile phone network, the malfunction of the passenger's computer or telephone terminal, must be promptly reported to the Help Desk at the address info@ferryontime.com. The issue of the duplicate may be take place only on condition that the original ticket is not already registered ; used, subject to identification of the passenger and payment of the amount of € 10.00, against the administrative and management costs incurred by the carrier for this purpose.
6) VARIATION PENALTIES
Changes in date, line, number of passengers, timetable will be accepted, within the limits of the seats and spaces available and on condition that they are requested at least 90 minutes before the booked departure (limited to call center hours), upon payment of € 10.00 as reimbursement of expenses for each variation (in addition to payment of any differences), only if indicated on the ticket. The change relating to the destination (example: from Corsica to Sardinia) involves the cancellation of the reservation, with the relative penalties and the reissue of a new ticket. Any difference in fare and variations regarding the number of passengers/vehicles, vehicle categories and accommodations will be reimbursed to the issuing agency with the following penalties: 10% if made more 30 days before departure; 20% if you make multiple ; 10 days before departure; no refund less than 9 days before departure. The number of days indicated does not include the day of the change and the day of departure. The variation & egrave ; permitted only in the context of the departures published in the brochure . The original ticket, prior to the modification, must be must be handed over to the agency that modified it .
7) SPECIAL OFFERS - RESTRICTIONS ;
Taking advantage of a special offer involves some restrictions: & nbsp ;
• The special offers are available subject to availability of seats allocated to them (seats vary according to date and line ).
• They are valid on all our destinations but only in the presence of a Best Price fare.
• All the offers published are valid as of 01/02/2013 and do not include any special offers and extraordinary promotional campaigns proposed by the carrier during the season, which may in any case deviate from the offers and conditions in force at the time of the print without having retroactive effect nor & eacute ; give any right with respect to contracts already in place ; concluded.
• In principle, the special offers cannot be purchased directly at the port on the day of departure but must be booked. • A ticket issued with special offers & egrave ; modifiable only for Sardinia and Corsica destinations on condition that the modification is requested at least 90 minutes before the booked departure (limited to call center hours). Each change involves the payment of a penalty, per route, equal to € 10.00 (Corsica) or € 25.00 (Sardinia), as well as any tariff differences. The penalties indicated above will also be applied in the event of a passenger name change. Notwithstanding the above, for the Island d& rsquo ;Elba and for the S. Teresa - Bonifacio and vv section, the ticket is not included . editable (not even name change).
• A ticket issued with special offers is not a valid ticket . not even partially refundable for any line/route. In case of cancellation, the ticket will be refunded . subject to a penalty equal to the total amount paid.
• In general, special offers, unless otherwise specified, are never retroactive, nor ; Can be combined with other discounts or promotions.
• The vehicles object of the promotional initiatives, unless otherwise specified, are always motorcycles and cars (also registered as trucks) within 5 m in length and 2.20 m in height. All vehicles - used for the transport of goods (with or without cargo) - do not have access to promotional initiatives. In general, vans and pick-ups are not considered cars. • When accessing a promotion which provides for the booking of a vehicle in tow, the personnel in charge of boarding will see the actual transport of this vehicle. If the latter is absent , the customer will be ; required to pay a penalty.
• In general, if the assistance personnel at the ports should detect anomalies in the booking, compared to what was present at the embarkation , they will request the confirmation . the payment of a penalty, even for the outward journey even if already paid ; carried out.
• The penalties generally correspond to the cost of the maximum rate in our price lists.
SPECIAL RATE FOR BORN OR RESIDENTS IN SARDINIA ;
to take advantage of the special rates for residents and natives of Sardinia, passengers must show a valid personal document , proving residence or birth in a Sardinian municipality, when purchasing the ticket and when boarding . . In the absence of the indicated documentation, it will not be accepted . It is possible to board with tickets issued at the & ldquo;resident or native&rdquo ; but it will be It is necessary to purchase a new full fare ticket. The resident or native fare ticket will not be included . refunded. A ticket issued with a resident rate, associated with an or special offer , is not a special offer . refundable. If the native or resident person makes the trip together with their relatives, they will be inspected . recognized the discount against a self- certification , no longer ; having to show family status. Non-resident spouses and children traveling in the absence of the native or resident person must accompany the family status document with the ticket. Non-retroactive offer. SPECIAL RATE FOR RESIDENTS OF ELBA OR PIOMBINO
, passengers must show the purchase of the ticket and , upon boarding , a valid personal document proving residence in a municipality on the island dell’Elba or in the municipality of Piombino. For vehicles it will have to ; the vehicle registration certificate showing that the vehicle is shown must be presented ; made out to a person residing on the island d’Elba or Piombino. In the absence of the indicated documentation, it will not be accepted . possible to embark with tickets issued at the rate & ldquo ; residents& rdquo ;, but it will be ; necessary to purchase a new full fare ticket. The resident fare ticket will not be issued . refunded. Non -retroactive offer.
8) FORFAIT & ldquo;TAXES , FEES , CHARGES AND OTHER COSTS&rdquo ;
The flat rate amounts & ldquo;taxes , fees, charges and other costs&rdquo ; are subject to variations until the ticket is issued , except in any case for taxes, fees and variations resulting from changes to the regulations in force. 9) CHECK-IN The time limit for presenting yourself at check-in is : 30 minutes for passengers without a car , and one hour and 30 minutes for passengers with accompanying vehicles, subject to any provisions issued by the Authorities . Immediately after validating the ticket, you must present yourself at the boarding . Once these terms have elapsed, the reservation is forfeited and will no longer be used . boarding guaranteed . _ For passengers with disabilities ; or to mobility ; reduced, the provisions of point 17 apply.
10) EMBARKATION AND DISEMBARKATION OF VEHICLES
A) Vehicles powered by liquid gas must be declared at the time of booking and boarding .
B) The alarm and electric burglar alarm systems must be deactivated when of embarkation .
C) Vehicles used for the transport of goods must make reservations and are subject to the tariffs foreseen for the transport of goods and therefore do not fall into the category & ldquo;vehicles &rdquo ; referred to in these conditions. The lengths of the vehicles are to be considered overall, including tow hooks, rudders or other. Campers, caravans, off-road vehicles or in any case vehicles with a height or size exceeding m. 2.20 from the ground (and/or of a width greater than 1.85 m although not subject to any width supplement), must be reported at the time of booking . Vans exceeding 6m in length must be booked by contacting the freight office on 199.30.34.10*. In the event of non-compliance with the above, the carrier may order the cancellation of the reservation and the automatic inclusion in the waiting list for the day, upon payment of the difference due as well as the penalty of 50 €, also for the outward journey, even if already paid ; carried out. The vehicles will not be embarked in the chronological order of their arrival at the quay, but on the basis of the instructions given by the ship's master and/or his subordinates and may be placed on any deck of the ship. They must be embarked, parked (with the handbrake on, the gear engaged and the lights off) and disembarked at the care and responsibility of the owner . of the passenger. Please do not activate the alarm but make sure that the doors and the boot are tightly closed. The vehicle, including any trailer or caravan with what is contained therein , is ; accepted by the carrier as the only unit ; of load. Also pursuant to art. 412 and 435 codes. nav., any damage to cars or any other harmful event that occurred on board the ships must be declared before disembarkation. For this purpose, the passenger must present a report to one of the ship's officers who will arrange for it . to the verification with a specific form, which must be completed ; be signed by the passenger.
11) PREGNANT WOMEN ;
Pregnant passengers can only embark upon written communication of their condition to the ship and presentation of a medical certificate issued no later than 48 hours before departure expressly authorizing the journey, which must be handed over to the u ship 's officer. Boarding implies acceptance by the passenger of the risks associated with the absence on board of specialist assistance and structures suitable for managing any emergencies connected to the condition of pregnancy, as well as to the specificities ; of transport by sea with consequent difficulty ; to access external assistance, with consequent indemnity and exemption from any and all liability ; for Moby and all its personnel.
12) UNACCOMPANIED MINORS ;
Children between the ages of 12 and 17 can also travel unaccompanied, under the responsibility of the parent . of the exercisers of the potestà ; parenting. & Egrave ; When boarding , it is necessary to present a written declaration, containing all the information shown on the ticket, with which the parent assumes responsibility for the travel . connected to the journey made by the minor, also attaching the family status and the identity document ; of the parent. Children under the age of 12 cannot travel alone but must be accompanied on boarding , disembarking and during the journey by at least one other adult passenger. If going to France, minors must have a valid document for expatriation . From 28 June 2012 all minors will be able to travel abroad only with an individual travel document ; from this date I am no longer ; all entries of minors on the parental document are valid.
13) ANIMALS
valid medical certificate . In compliance with the provisions of the O ordinance of the Ministry of Health of 27/8/2004 and published in the Official Gazette no. 213 art. 2, please note that dog owners must wear a muzzle and keep their dogs on a leash. Pets are not accepted in the cabin or in the seating area. They are only allowed on the external decks of the ship or, where available, in suitable shelters subject to availability . Guide dogs intended to assist blind people, if provided with the relevant documentation, are exempt from paying the ticket. Specimens belonging to protected animal or plant species, in compliance with art . 727-bis of the penal code, implementing the community directives 92/73/CE, and 2009/147/CE, as well as ; to the Law n. 150 dated 02/07/1992 implementing the EC Regulation n. 338/97 of the Council of 12.9.1996, can be transported only if equipped with the relative license or certificate and under the conditions set forth therein.
14) TRANSPORT OF WEAPONS & nbsp ;
In compliance with the Regulations for maritime navigation DPR n. 328 of 2/15/1952 Art. 384 - & ldquo; Passengers , upon before boarding , they must deliver to the ship's captain, who will keep them safe until disembarkation, the weapons and ammunition in their possession. The withdrawal of arms or ammunition from those who hold them by reason of their office or service is prohibited . admitted only for serious and verified reasons to be indicated with a specific declaration at the time of withdrawal.& rdquo ; Failure to report the transport of weapons is sanctioned on the basis of art . 1199, second paragraph of the code nav., unless it is no longer a ; serious crime.
15) PASSENGER INFORMATION ;
In compliance with the Law Decree n. 251 of 10/13/1999 implementing EEC Directive 98/41 of 06/18/1998 and the regulations relating to the application of the ISPS code on anti-terrorism regulations, we inform you of the following: all embarking passengers are required to notify the carrier any information relating to your needs ; of special assistance care in emergency situations. Passengers who need assistance for boarding (people with mobility difficulties , etc., both by car and on foot) must communicate this when booking, by contacting to find out the availability of the bus . of suitable accommodations and/or facilities ; to access on board, the actual carrier's call centre; they are also required to show up for boarding at least two hours in advance, highlighting this need ; to the dock staff and/or the on-board staff in order to allow boarding of the car near the car of suitable access to the ship and any assistance during the embarkation and disembarkation operations. Passengers are also ; required to communicate already ; during the booking phase, your personal details ; intended as: SURNAME, NAME or initial of the same, SEX, AGE CATEGORY ; (infant, child, adult). In the event of a change in the data highlighted above between the time of booking and the time of boarding , passengers are obliged to communicate these changes. Personal data, collected pursuant to this article, are kept only for the time necessary for the purposes of the aforementioned decree and/or in compliance with the provisions of Legislative Decree n. 196/2003. Please note that for departures from Italy to France or vice versa , it is necessary to pay a fee . a valid document for expatriation is required upon boarding (passport or identity card , even for minors). From 28 June 2012 all minors will be able to travel abroad only with an individual travel document ; from this date I am no longer ; all entries of minors on the parental document are valid.
16) HEALTH CONDITIONS OF THE PASSENGER
The ship's doctor, where present, provides assistance only in emergencies; therefore, the carrier does not accept passengers who require medical assistance during transport, except as provided for in point 17 below. In the presence of a suitable medical certificate issued no later than 48 hours before departure and issued by a public health facility (hospital, Asl), certifying that the passenger does not need health care during transport, the carrier will embark ; said passenger declining any responsibility ; to about. Furthermore , the embarkation of passengers is subject to the judgment of the Captain and the on-board doctor, where present, if they are in physical or mental conditions such that they do not allow them to undertake the journey or such as to cause nuisance or cause danger to self ; and for the others, for abuse of drugs, hallucinogens and alcohol. In all of the aforementioned cases, the passenger will not have to pay . right to compensation for damages and will be ; responsible for damages caused to his person, to the ship, to all its fittings or equipment, to third parties as well as ; to third party things. There a Acceptance of the passenger on board by the carrier must not be accepted ; be considered as a waiver of any of its rights to subsequently assert its reservations on the conditions of the passenger, known or not by the carrier at the time of boarding and/or departure of the ship.
17) PEOPLE WITH DISABILITIES AND PEOPLE WITH MOBILITY ; REDUCED ;
The carrier accepts bookings from people with disabilities ; and to mobility ; reduced to the same conditions applicable to all other passengers, subject in any case to the provisions of EU regulation/1177/2010 ( information relating to this legislation is available on the website www.moby.it). People with disabilities or people with mobility ; reduced must notify the carrier at the time of booking or advance ticket purchase of their specific needs for accommodation, seating, services requested or the need for travel . to transport medical devices as long as they are such needs or necessities ; are known at that time. The notification can be be forwarded to the travel agent or tour operator from whom it was received . ticket has been purchased. The carrier provides the passenger with the necessary information relating to the conditions of access and assistance on board, including the times of presentation at the port of departure. If it is strictly necessary , the Carrier can require that a person with a disability be able to or a mobility-impaired person ; reduced is accompanied by another person (companion) able to provide the necessary assistance to the person with a disability ; or to the mobility-impaired person ; reduced. There a ccompanion in question & egrave ; carried free. If a person with a disability is or a mobility-impaired person ; reduced & egrave ; accompanied by a recognized assistance dog, the latter is required to be accompanied by a recognized assistance dog . accommodated with the person in question, provided notification is given to the carrier in accordance with the law ; applicable national rules on the carriage of recognized assistance dogs on board passenger ships. The Carrier can ; refuse to accept a reservation, issue a ticket or embark a person with a disability ; or a mobility-impaired person ; reduced for the purposes of the o compliance with applicable security obligations established by international, European Union or national legislation or for the purposes of compliance with security obligations established by the authorities ; competent; or if the design of the ship or of the infrastructure and equipment of the port makes it impossible to embark , disembark or transport the person in question in safe or practically achievable conditions; in this case, he immediately communicates the specific reasons to the person with a disability ; or to the mobility-impaired person ; reduced. Upon request, such reasons shall be notified to the person with a disability in writing ; or to the mobility-impaired person ; reduced no later than five days after the request. If the person with a disability is or to the mobility-impaired person ; reduced, who is in possession of a reservation or ticket and who has duly notified, is denied boarding in any case , she and any accompanying person may choose between the right to a refund and alternative transport, subject to compliance with all safety obligations. Fault or negligence of the carrier is presumed when the damages were caused by a marine accident. The compensation referred to in paragraph 1 corresponds to the replacement value of the a equipment concerned or, if applicable, the cost of repairs. These provisions do not apply where Article 4 of Regulation (EC) No 1000/2004 applies. 392/2009. The disabled or mobility impaired passenger ; reduced which also requires assistance with boarding & egrave ; required to inform the Carrier at least 48 hours in advance of its needs ; and to arrive at least 60 minutes before departure time.
18) BOARDING INFORMATION AND NAVIGATION REGULATIONS
Passengers at the act before boarding, they are required to take all valuables and anything necessary during the crossing from the car (all ships are air-conditioned). The carrier is not liable for any missing items and/or equipment from the car . & Egrave ; it is absolutely forbidden to get off the ship after having carried out the embarkation operations. If the ship is equipped with a side entrance for foot passengers, access to the garage by car is required ; admitted only to the driver, accompanying passengers must use the side staircase with the nominal check-in coupon. & Egrave ; absolutely forbidden to enter the ship's garage during navigation.
19) ACCOMMODATIONS
At the time of boarding & egrave ; It is essential to present yourself at the Reception on board for the a cabin or seat assignment. In the absence of the above, they will be relisted 1 hour and 30 minutes after the ship's departure. The cabins must be vacated at least one hour before arrival at the port. The purchase of the cabins on board will be increased by € 10.00.
20) SECURITY INFORMATION AND ISPS COSTS
In compliance with the ISPS international code relating to anti-terrorism regulations, passengers are informed that they are required to show their travel ticket and identity document ; if requested by a ship's officer. I am also ; required to consent to any inspections of their baggage if required. These checks can also be performed by the port structures. We remind you that during the stop of the ships in the port & egrave ; it is prohibited to approach within 50 meters of the ship and the moorings. Furthermore, in relation to the a pplication of the ISPS code, the carrier informs that the authorities port operators may have further requests and the payment of additional taxes, not yet quantified at the time of printing of this brochure.
21) DECLARATION OF THE VALUE OF THE FOLLOWING CAR
It is specified that this is limited to direct material damage, possibly suffered during
transport by passenger cars, in accordance with current legislation, for facts attributable to the carrier, notwithstanding the provisions of art . 423 code nav.,
the carrier waives the right to make use of the compensation limit of € 103.29 , provided that all additional legal and contractual conditions exist which give the right to compensation for any such damage . indemnified in its entirety ,
with no ceiling. The above disclaimer, therefore, makes for
superfluous
passengers presenting the declaration of value of the accompanying car .

22) VEHICLE NUMBER PLATE
On the basis of current regulations, the Authorities oblige the shipping companies to provide the identification number of the license plate of all the vehicles transported: passengers with motor vehicles in tow therefore have the obligation to provide this data to the Shipping Carrier. This legislation does not apply to travel to and from the island of Elba .
23) LOST PROPERTY ;
If the passenger forgets or loses personal belongings on board, he will be able to ; contact the reception of the ship or, once disembarked, you can ; fill in the appropriate form which can be downloaded from the actual carrier's website (which, in the case of Moby , is www.moby.it) and send it to the relative e-mail address (for Moby: oggetti.smarriti@moby.it). The carrier, as soon as it receives the report, will arrange for it . to immediately carry out all the necessary searches, without being required to pay any compensation in the event of failure to find the objects forgotten or lost on board by the passenger.
24) RESPONSIBILITY ; OF THE EFFECTIVE VECTOR
If the sea carrier operating the transport is not the contracting sea carrier, the actual carrier assumes the liability ; of transport pursuant to art . 1681 of the cod. civ. and of the CE/392/2009 regulation, therefore the passenger has the right to act directly against him. The indication of the actual carrier, if different from the contracting carrier, can be included . take place from the time of booking in which case & egrave ; indicated on the ticket or by communication within 24 hours of departure.
25) APPLICABLE LAW AND JURISDICTION
, luggage and accompanying vehicles is governed, except as provided in these conditions, by Italian law , and is interpreted in accordance with to the same. For any controversy arising from the interpretation and/or execution of this contract, the competent court is the competent court . exclusively that of the registered office of the carrier. Furthermore, in the case of a passenger residing in Italy who qualifies as a consumer pursuant to current Italian law, the payment will be made . the court of residence or elective domicile of the same is exclusively competent .
26) GROUP RATES
There are special rates for groups, for information contact the call center or travel agencies .
27) TRANSPORT OF GOODS
FerryOnTime remains available for any information, quotations and reservations relating to the transport of goods. Any updates made to the general conditions of carriage, special offers or operatives will be published on the website www.moby.it.
